Joby A. Hughes

IAM Magazine: Top 250 Patent Strategists in the World

Thirty-five years helping companies, investors, insurers, and litigation teams make economically sound decisions about patents and IP disputes, by translating legal merits, enforcement risk, and transaction options into a practical business recommendation. The enforcer and the accused. The acquirer and the target. The investor and the founder. Every seat at the table.

Every seat
at the table.

Most specialists know their corner of the room. Joby Hughes has sat in every chair. The enforcer and the accused. The acquirer and the target. The private equity firm and the founder who built the company. The risk analyst pricing the exposure and the builder taking it on.

That breadth is the core of what makes him useful. When you've occupied every perspective across decades of complex IP, technology, and commercial work, you understand motivations, pressure points, and decision calculus that no single-sided practitioner can.

When people need someone who has seen it from every angle, the answer is usually simple: just call Joby.

Entrepreneurial Advisory

Technology Ventures & Founder Advisory

Mediation & Dispute Resolution

The approach

Effective mediation in intellectual property disputes requires more than process management: it requires someone who understands what's actually at stake technically, commercially, and strategically. Joby Hughes has occupied every seat relevant to IP disputes: enforcer and target, acquirer and founder, risk analyst and builder. Both parties recognize, quickly, that he understands their position from the inside.

Mediation hits the pause button. The parties, their attorneys, and key advisors are all present, and for that window of time, everyone's sole focus is the dispute at hand. Mediation compresses weeks or months of fragmented back-and-forth into a single structured, focused environment.

My task as your mediator is to help the parties reach resolution. Better-informed people make better decisions. My objective is not simply to get a number on a piece of paper: it is to ensure that each party understands their case more clearly after mediation than before, including the other side's real motivations and expectations, and the realistic costs and risks of continued litigation.

International matters: Available for international commercial mediations and arbitrations. Proceedings conducted in English. Working proficiency in French (A2/B1), relevant in WIPO proceedings, European IP matters, and disputes involving francophone African commercial parties.

My first question when I hear someone has been through mediation is always: what did you learn?

Risk & Structured Finance

IP risk quantification & structured finance

Most intellectual property disputes are ultimately financial decisions dressed up as legal ones. The question is rarely whether you can win: it is whether winning is worth it, and what it costs to find out.

Joby Hughes spent years building the analytical tools that answer those questions with rigor. His proprietary frameworks for quantifying IP litigation risk were developed working with patent enforcement entities and ultimately adopted within the Lloyd's of London insurance market as industry standards. He subsequently led an IP practice at Marsh and co-founded Altitude Capital Partners, applying the same analytical discipline to IP asset investment and monetization.

Portfolio Holders & Enforcement Entities

Evaluating an enforcement campaign requires rigorous analysis of expected value, cost curves, and jurisdiction-specific risk. Joby brings the frameworks that institutional markets use to price these decisions.

Litigation Finance & Insurance

Structuring coverage or financing around IP litigation outcomes. Risk quantification and modeling for funds, carriers, and underwriters who need defensible analytical frameworks.

Private Equity & M&A Diligence

Identifying IP risk in investment targets, acquisition structures, and exits. Pinpointing exposure in documents, organizational structures, and portfolio positioning before it becomes a problem.

Expert Consulting

Non-testifying and testifying expert services. Thirty-five years on every side of IP matters, enforcement, defense, licensing, and valuation, provides the depth litigation teams need when the analysis has to be right.

Background

Joby A. Hughes

Joby A. Hughes has spent 35 years working at the place where technology, law, and commerce intersect, not as a spectator, but as a practitioner, strategist, and builder. His technical foundation spans software and engineering, giving him something most IP attorneys lack: the ability to engage with what a technology actually does, not just what a patent claims about it. His current ventures include software platforms addressing behavioral analytics and data infrastructure, energy technology, and advanced materials for industrial applications. He has worked at the architecture level, not just the advisory level.

He has litigated and counseled in landmark intellectual property matters, including cases that reached the Federal Circuit and defined the boundaries of patent-eligible subject matter in software and data systems.

What separates his practice from most is the range of perspectives he has occupied. He has been the enforcer and the accused, the acquirer and the target, the private equity firm running diligence and the founder on the other side of the table, the risk analyst pricing exposure and the builder taking it on. Across 35 years, he has sat in every seat.

He developed proprietary models for quantifying IP litigation risk adopted within the Lloyd's of London insurance market and institutionalized as industry standards. He subsequently led an IP practice at Marsh and co-founded Altitude Capital Partners. He has spoken internationally on IP risk quantification, patent litigation strategy, and licensing economics across multiple countries.
